Is the investment refundable?
By USCIS regulations, all EB-5 capital must remain "at risk," meaning returns and capital repayment cannot be legally guaranteed. However, Open EB5 projects are structured with clear exit strategies, disciplined risk management, and full transparency to safeguard investor capital. Additionally, subscription agreements typically include refund provisions in the event of an I-526E petition denial, all of which are reviewed individually with independent counsel.
Do I need a lawyer separate from Open EB5?
Yes. Every EB-5 applicant must retain independent U.S. immigration counsel to file the I-526E. Open EB5 works with several established firms and can refer you, but the attorney-client relationship is yours, not ours.
